When do you need a trademark attorney?

DO i need to hire an attorney?

So you have a trademark that you want to register, what now?  Is an attorney absolutely  necessary?

If you are not domiciled in the United States then you are required to have a U.S. licensed attorney file and handle your trademark matters on your behalf.  Your domicile is the country where you live and consider your permanent home.   A business’s domicile is normally where the headquarters is located at, where executives or management direct and control the business’s activities.  If your or the business’s domicile is in a foreign country, a U.S. licensed attorney must be the one to file your application.

In order to represent your trademark matter, the U.S. attorney must be an active member in good standing of the bar in any U.S. state.

If you are domiciled in the U.S, you are not required to have an attorney file or handle your trademark.  However, having an attorney who specializes in trademark law on your side is invaluable to properly protect your intellectual property.

An experienced attorney will be able to prepare your application in a timely, cost-effective manner, ensuring you are prepared for potential future problems, as well as making sure your trademark has the broadest protection possible.  They will be able to help with your application prior to filing, during the filing process, as well as in maintaining your trademark and preserving all of your trademark rights.
